(from now on, GLOBAL PIRANHAor simply PIRANHA) with headquarters at Parque Industrial Coimbrões, Lote 71, in Viseu, NIPC nº PT 507 776 003, registered at the Commercial Register Conservatory of Viseu, is the legitimate owner of the official website of the brand PIRANHA® and whose domain can be found in piranhasupplies.com.

  3. Object and scope

3.1. The present General Terms and Conditions of Sale regulate exclusively the purchase and sale made in the online store of PIRANHA®between Professional Client as Buyer and GLOBAL PIRANHA as a seller, and apply to all visitors of the website piranhasupplies.comas well as any transaction of a commercial nature performed through this online virtual store.

3.2 The navigation on the site, as well as the purchase of any product in piranhasupplies.com, implies the acceptance of these general conditions of use and contracting.

3.3. A PIRANHA GLOBAL LDA. markets all products of the brand PIRANHA® and other brands that PIRANHA GLOBAL LDA represents, and will be the entity responsible for the sale on the site piranhasupplies.com of articles of those brands, and all e-commerce services are only available for Professional consumers.

3.4. Professional Customers or Users or Buyers are considered to be all persons who act/purchase with the intention of professional use, for use in their business or profession, therefore, without any desire to resell the items they purchase in the online store PIRANHA® unless expressly authorized, registered by email or registered letter by the representatives of the GLOBAL PIRANHA.

3.5. A GLOBAL PIRANHA reserves the right to change these conditions of use and contracting, without prior notice, as well as to modify at any time the information and commercial offer presented about products, prices, promotions, commercial conditions and services, and any change will always be published on the site piranhasupplies.com.

3.6. PIRANHA®(PIRANHA GLOBAL LDA.) reserves the right not to process any order received from users who are not Professionals or those who are not in accordance with the general sales conditions of the Seller(PIRANHA®). Nor is it responsible for any administrative costs arising from the processing of advance payments for purchases that violate these general conditions.

3.7. The “Professional Client” shall provide PIRANHA®(PIRANHA GLOBAL), as seller, with a correct and complete e-mail or postal address or other contact details and agrees that PIRANHA® may contact her/him using those details should it deem appropriate.

4.2. It is strictly forbidden to introduce links from our website for commercial purposes or without prior authorization from PIRANHA®(PIRANHA GLOBAL), as well as the use of the domain piranhasupplies.com for abusive purposes, without prior authorization, will be subject to legal action by PIRANHA®(PIRANHA GLOBAL).

4.3 In the event that you find, on other websites, links that allow you to access piranhasupplies.com or references to the online store PIRANHA® we inform you that PIRANHA GLOBAL has no responsibility for the links or pages, nor for the content included therein.

4.4 We are strongly committed to ensure that the information presented in piranhasupplies.com is free of typographical errors and whenever they occur, we will correct them as soon as possible.

4.5. All contractual information is written in Portuguese, as is the information on the articles, e-mail communications, and formalization of the sale, with the exception of expressions very specific to the business world.

  1. Trade Policy

    1. In case the information presented does not correspond to the product’s characteristics, the Customer is entitled to rescind the purchase and sale contract under the applicable legal terms.

5.2. The photographs shown on the website are merely illustrative, so we recommend that you take a long look at the product details for better information about the respective characteristics of the items you intend to purchase.

5.3. Prices and product specifications are subject to change without notice. Despite PIRANHA®(PIRANHA GLOBAL) extreme care to keep all information updated, some products may contain an incorrect price, so we will check the prices whenever we process orders. If the price is higher, we will inform you by e-mail and wait for your decision whether to accept the new proposal or cancel the order.

5.4 The product catalog of the online store PIRANHA® is independent from other online stores, both in terms of price, products presented and quantities in stock. All promotional campaigns have limited stock and are exclusive to the PIRANHA® online store.

5.5 The validation of the purchase order or order determines that the Buyer is aware and accepts the Conditions and General Terms of Sale of the piranhasupplies.com website.

5.6 All data recorded by PIRANHA®(PIRANHA GLOBAL) constitutes proof of the set of transactions carried out between the Seller and the Professional Client, being the responsibility of PIRANHA®(PIRANHA GLOBAL) to file the electronic document in which the contract is formalized.

  1. Clients’ and Users’ Obligations
    1.Any visitor to the website piranhasupplies.com undertakes to comply with and respect these general conditions, in particular by observing the following obligations: It is prohibited to introduce, store or disseminate through the PIRANHA® website defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order; Keep, and do not disclose, your password to enter the site in order to prevent others from accessing your account and personal data; Do not use false identities; Provide your personal data and correct addresses so that the PIRANHA GLOBAL(PIRANHA®) can properly process orders;

6.3 PIRANHA®(PIRANHA GLOBAL) is exempt from any responsibility for any delay or impossibility to process the order due to error or insufficiency of the data communicated by the Professional Customer, namely at the moment of delivery.

  1. Ordering online

    To place an order in piranhasupplies.com is necessary that the User has a valid e-mail account and frequent use and that he/she registers as a PIRANHA® Customer by filling out the form available online. Once registered, all you have to do is to insert in the virtual shopping cart all the products that the Professional Client wishes to purchase, following all the steps of the purchase so that it is processed successfully.

7.2 Placing an order in piranhasupplies.com is very easy: Browse the pages of the online store PIRANHA and find the products you want to buy; Add the products you prefer to the shopping cart using the buy button; Then, fill in your personal data in a very simple form (very careful when filling in the address); Then, select the payment method; Review your order; Proceed to payment by confirming the order; Finally, you will receive an order confirmation via e-mail; At the end of the buying process, your order is confirmed and you will only have to wait for the days foreseen for the postal delivery of the pieces.

7.3. As soon as you finish your purchase, you will receive an automatic e-mail confirming the transaction barring technical problems. We suggest you print or download this copy for future reference. If the data is not correct, you can immediately ask for it to be changed, or even cancel the purchase made.

7.4 In case of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, PIRANHA®(PIRANHA GLOBAL) reserves the right not to accept your order, or to cancel it totally or partially, even after its automatic confirmation.

  1. Product availability and order confirmation/cancellation

    1. PIRANHA®(PIRANHA GLOBAL) only processes an order placed by a customer after confirmation of the respective payment, and therefore PIRANHA®(PIRANHA GLOBAL) cannot guarantee the availability of the articles until the beginning of such processing.

8.2. The package is sent by a carrier contracted for the delivery service.

8.3 PIRANHA®(PIRANHA GLOBAL) only ships orders on business days. Thus, for estimating the delivery time of orders, neither weekends nor holidays are counted. Any delay in shipping the items, compared to the estimated dates presented, does not give rise to the right to compensation.

8.4. Satisfaction of all orders placed on the site is subject to product availability. PIRANHA® tries to ensure that all items offered for sale on the website are in stock. However, PIRANHA®(PIRANHA GLOBAL) reserves the right not to accept any orders or cancel orders already confirmed for products that are out of stock. In case of unavailability of the product and/or stock rupture, PIRANHA GLOBAL(PIRANHA®) will immediately inform the Professional Customer of the partial or total cancellation of his order.

  1. Order Confirmation or Cancellation

    1. PIRANHA®(PIRANHA GLOBAL) may not validate the order that does not have sufficient guarantee of good collection, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of the cases referred to, PIRANHA® will inform the Professional Client via e-mail that the sales contract has not been made and that PIRANHA®(PIRANHA GLOBAL) has not proceeded with the sale, specifying the reasons for this.

9.2. If the products ordered in piranhasupplies.com are no longer available at the time of your last access to the site, even though you have obtained order confirmation, or when the PIRANHA® (GLOBAL PIRANHA) receives your order, the Seller will immediately inform the User about the unavailability of the same, never exceeding 30 days after receiving the order.

9.3. If an order has been placed, and payment made, for products that have become unavailable, PIRANHA®(PIRANHA GLOBAL) will refund the money paid for the unavailable items.

9.4. PIRANHA®(PIRANHA GLOBAL) reserves the right to refuse any order, regardless of the reason and exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase even if it has already been accepted or confirmed by PIRANHA®(PIRANHA GLOBAL)), namely in the following situations: The information on the invoice is not correct or verifiable; The order is flagged by the website’s Security Systems as an incorrect, irregular order, or an order susceptible to fraud; When, being the option chosen, the payment transfer was not received within 5 working days after the acceptance of your order; When it is not possible to deliver the order to the address provided by the User; If you consider that the Buyer did not have the capacity to perform that act. If it turns out that there was an error in the presentation of the price of the product(s); If it is assumed that the order came from a reseller.

9.5. Piranha Supplies is a site that sells exclusively to professionals (as stated on the site itself). For orders unduly placed by consumers (for which payment is made before Piranha cancels the order), the amount to be refunded will be reduced by €2.00 (two euros) to cover the administrative costs of the refund.

  1. Payment Terms and Security Guarantees

    The available payment methods will be presented at piranhasupplies.com. We do not accept any other method of payment besides those mentioned.

10.2. You can pay for your products using your usual credit and debit cards, through the Paypal payment system, against reimbursement, or you can also pay your order through the MULTIBANCO website PIRANHA® will offer you the necessary instructions for this payment method.

10.3. For payments using a credit or debit card, all details (such as card number, expiration date, or security code) will be sent by encrypted protocol to the company that provides the remote electronic payment services, Paypal, without any third party being able to access the transmitted information. This information will not be used by PIRANHA®(PIRANHA GLOBAL), except to carry out the necessary operations for purchase or chargeback (refund), in case of return in accordance with the exercise of the right of return, or for reporting cases of fraud to the police.

10.4. If the Professional Client chooses to pay by BANK TRANSFER, we will only start processing the order after we have received the payment. Therefore, in this payment method, we advise you to go to the ATM as soon as possible so that you receive your order as soon as possible. Once 5 calendar days have passed after placing the order, and if we have not received any payment, the order will be cancelled.

10.5. The purchase price of the products and the shipping costs, as indicated on the order form, will be charged to the current account when the purchased products are actually shipped.

10.6 We urge you not to attempt to make payment by any means not specified on piranhasupplies.com. If you attempt to do so, PIRANHA®(PIRANHA GLOBAL) cannot be held responsible for lost payment, or any other damages that may result.

  1. Security of the PIRANHA® online store and of all transactions

    1.The PIRANHA®online store usesthe latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted, from the initial moment of your transaction, until the order is processed, and will not be stored on any public server.

11.2. Although we use state-of-the-art encryption software, any payment transmitted over the Internet, or by e-mail, runs some risks, particularly when the User does not take the necessary precautions and does not assume the necessary responsibility.

11.3. THE PIRANHA®(GLOBAL PIRANHA) shall not be liable for any damages incurred as a result of the use of electronic means of communication, including damages arising from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.

  1. Reservation of ownership of the commercialized products
    PIRANHA®(PIRANHA GLOBAL) retains ownership of the company’s products until it has received full payment for all such products.
  2. Prices
    1.The prices of the products displayed on the piranhasupplies.com contain/contain Value Added Tax (VAT).

13.3. The total price specified in the Professional Customers menu at checkout includes taxes and shipping costs. Prices are quoted when you confirm your order, which you can print or download for future use. Please transfer only the exact amount specified in the order confirmation and make individual transfers per order.

13.4. Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country where your order will be delivered. The shipping cost is specified at the end of the purchase.

13.5. The prices are all broken down in Euros and any change in the country of delivery of the order may have an influence on the prices due to transport costs.

  1. Quality and Assurance
    1.A PIRANHA®(GLOBAL PIRANHA) will only market in piranhasupplies.com articles of the highest quality and will never sell second-hand products, defective or of inferior quality to the existing standards in the market, if this happens we will trigger the warranty given by the represented brands, being them responsible for assuming the inherent costs except for shipping.

14.2. The products offered for sale on piranhasupplies.com may not correspond exactly to the actual article with regard to the displayed image and colors, especially due to the internet browser and monitor used.

  1. Product Shipping and Delivery
    1.The products ordered in the online store PIRANHA® will beshipped and delivered on business days, Monday through Friday.

15.2. We can only guarantee the successful delivery of an order if the shipping address of the products is correctly indicated by you and is located at a home or office located in one of the countries mentioned in the list of countries available in the Shipping Information menu.

15.3. A delivery is considered made or a product is considered delivered when the delivery receipt is signed at the agreed address.

  1. Shipping Costs and Delivery Times

    1.The shipping charges associated with your order will be billed per order, i.e. if you order more than one item, you will only pay the shipping charges once. However, PIRANHA®(PIRANHA GLOBAL) reserves the right to split the delivery of the order, for example, if part of the order is delayed or not available. In case we proceed to split the order, the customer will be notified of our intention by e-mail. The e-mail address provided by the customer at the time of purchase will be used for this purpose.

16.2. Deliveries are priced for mainland Portugal, the Azores and Madeira archipelagos, and Spain. For shipments to other countries, prices are upon request.

16.3. At the time of delivery, the Buyer must inspect the packaging and the products shipped for any damage. If you find that the products are damaged, the customer should not accept delivery of the order, which should be returned immediately through the Return mechanism provided in piranhasupplies.com. PIRANHA®(PIRANHA GLOBAL) will refund the amounts paid for the order and shipping as soon as it receives and completes the return process at its headquarters.

16.4. The order is deemed accepted if, after receiving the order, the Buyer does not return the order within 15 days.

  1. Order Delivery Times

17.1. After registering your order, confirming the respective payment and being available all the pieces of your order, PIRANHA®(PIRANHA GLOBAL) is committed to follow up the shipment, observing the following estimated delivery times: In Continental Portugal and Spain, within a maximum of 3 working days. In the Archipelago of Madeira and Azores, between 5 and 10 working days, In the European Union (except Portugal), approximately 8 working days. In all countries outside the European Union, we will deliver the order within an indicative period of 10 working days.

17.2. PIRANHA®(PIRANHA GLOBAL) shall not be liable for the non-performance, or delay in performance, of any shipping obligation caused by a force majeure event, i.e. an event, act or omission beyond its reasonable control.

  1. Exchanges and Returns of Products

18.1. The non-acceptance of the return occurs in case of package violation, use, or damage to the products.

18.2. After receiving the order, the Buyer has 30 days to return or exchange the item(s) in case of defective products.

18.3 PIRANHA® only allows exchanges of articles for products of the same brand of the exchanged article, that is to say that an article of the PIRANHA brand can only be exchanged for an article of that brand.

18.4. In returns and exchanges, shipping costs will be borne by the customer (except for quality reasons).

18.5 The exchange or return of orders should be done by sending the items you wish to return to PIRANHA‘s address, in their original packaging, without any trace of use, enclosing a copy of the invoice of your order.

18.6. Upon receipt of all or part of the ordered products at our facilities, we will process them within an average period of one week. If the return is confirmed, you will be refunded using the same payment method. Refunds are only made to the account/card from which the purchase was made. In the case of a simple exchange of article, color or size, then, after checking the availability of that product, it will be sent to the address indicated in the exchange process.

  1. Order Cancellation

19.1. Before shipping, the Buyer can cancel the order of products. If you place an order and wish to cancel it, you should first check the order status.

19.2. If the cancellation request is successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer.

19.3 If the cancellation request is not possible because the order has already been shipped, the products will be sent to the Buyer who, if he/she maintains the intention to cancel the order, should refuse to receive them by activating in the online store PIRANHA® the return mechanisms. In this case, shipping costs will be borne by the customer.

19.4 Upon confirmation of the return and receipt of the order at PIRANHA®(PIRANHA GLOBAL) headquarters, the chargeback (refund) will be processed.

  1. Conditions that apply to Promotional Codes (discounts)

20.1. When used according to the established rules, a promotion code entitles the user to take advantage of a promotion/discount on the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.

20.2. Promotional codes are personal and non-transferable and can only be used on online purchases made on the site. You may not sell, trade, or give away a promo code. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of gift, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.

20.3. The use of a promotional code is conditioned to only one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.

20.4. Promotional codes cannot be exchanged for cash and will not be re-issued or refunded.

20.5 Without prejudice to any other rights, PIRANHA®(PIRANHA GLOBAL) reserves the right to immediately invalidate the issued promotional code if it suspects that a promotional code is being used in violation of the above mentioned assumptions.

  1. Validity of promotions or commercial campaigns

21.1 Promotional offers or commercial campaigns disclosed on the piranhasupplies.com website are valid only for the moment in which they are displayed on the website and in accordance with the conditions established, unless otherwise communicated on the website.

21.2. In case of return or exchange of items purchased under commercial campaigns or promotions, you will be credited or given only the amount you actually spent on the purchase of the item you want to return or exchange.

  1. Responsibility

22.1 PIRANHA®(PIRANHA GLOBAL) shall only be liable for damages suffered by the Buyer in the event that such damages result from breaches attributable to PIRANHA®(PIRANHA GLOBAL)’s contractual obligations to the Professional Customer, or in the event that the liability results from applicable legal law. 23.2. In the event that the Buyer has suffered damage in connection with the website activity, the liability of PIRANHA®(PIRANHA GLOBAL) shall be limited to: damage to PIRANHA® products, reasonable and verifiable costs incurred by the Buyer as a result of the breach by PIRANHA®(PIRANHA GLOBAL) of these General Terms and Conditions of Sale.

22.2 PIRANHA®(PIRANHA GLOBAL) cannot be held responsible for damages suffered by third parties resulting from the use of any of our products. PIRANHA®(PIRANHA GLOBAL) cannot be held responsible for damages suffered by the Buyer as a result of improper use of our products.

22.3 PIRANHA®(PIRANHA GLOBAL) is not responsible for damages that result from incorrect information on the website.

22.4.All products marketed by PIRANHA®(PIRANHA GLOBAL) are in accordance with the Portuguese and European Community legislation.

22.5. PIRANHA®(PIRANHA GLOBAL) declines any responsibility in case of violation of the legislation of the country where the order is delivered. It is up to the Customer to verify with the local authorities the conditions of importation or use of the products he intends to order.

  1. Intellectual and Industrial Property

23.1 All works, illustrations, works and images reproduced or represented on the piranhasupplies.com website are strictly reserved under copyright law as well as intellectual property rights, for the whole world. Accordingly, under the terms of the Intellectual Property Code, the use of information is only authorized for professional purposes, subject to contrary provisions including more restrictive provisions contained in the said code.

23.2 Any total or partial reproduction or representation of the piranhasupplies.com website, in whole or in part, of the elements included in it is strictly prohibited.

23.3 The corporate names, brands and distinctive signs reproduced in the piranhasupplies.com website are protected under the terms of the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the PIRANHA® trademark.

23.4 If the User wishes to use information or materials from the site, prior written consent must be obtained from PIRANHA®(PIRANHA GLOBAL).

  1. Applicable Law

24.1 These General Terms and Conditions of Sale and all disputes arising in connection with these general conditions, including their validity, the use of the piranhasupplies.com website or any purchase in the same shall be governed by Portuguese Law.

24.2. In the event of a dispute regarding the interpretation or execution of these General Terms and Conditions of Sale, the PIRANHA® (GLOBAL PIRANHA) and the Buyer agree to endeavor to reach an amicable solution, which is fair and adequate, within sixty (60) days from the receipt of the communication addressed to this effect by either party.

24.3. In the absence of an amicable solution, under the terms of the previous number, and in the event of non-compliance with these Conditions and General Terms of Sale, both PARTIES establish the Civil Court of Viseu as the competent jurisdiction, expressly waiving any other.

  1. Alteration of the General Terms and Conditions of Sale of the online store PIRANHA®.

PIRANHA®(PIRANHA GLOBAL) has the right to change these General Terms and Conditions of Sale at any time. Buyer is subject to the principles and terms in effect at the date of its order, unless any change is required by law or competent authority.

  1. Personal Data Protection

PIRANHA GLOBAL, LIMITADA, fully respects the confidentiality and privacy of the personal data of those who access and use its website. The data collected, the purposes, recipients, security and conditions under which PIRANHA GLOBAL, LIMITADA collects and processes personal data is set out in the “Privacy and Personal Data Policy” and “Cookies” on the site, which is an integral part of these Terms and Conditions

27. WARRANTIES

To make a repair/RMA request, you must fill out the form and return it along with the shipment of the equipment. The form must be duly completed and signed. The client should keep a copy for himself.

The articles marketed by Piranha Global Lda. in your online store and commercial spaces are covered by the legal warranty regime. Before purchasing a good, keep in mind the following points described on this page:

  1. Some of our products may only offer a 1-year warranty. Consult us before buying, to be sure of the warranty period;
  2. If you have difficulties installing/using any product, first make sure that you follow all the instructions contained in the Manufacturer’s Instruction Manuals, particularly on installation and use. If the problem persists, please contact the manufacturer directly or contact our technical department;
  3. In cases of RMA, Piranha Global Lda. is committed to do its best to have your product exchanged as soon as possible, but the Customer must keep in mind that the process does not depend exclusively on the seller (Piranha Global Lda.). All products that enter our facilities for RMA are tested and shipped as soon as possible. From then on, the process becomes the responsibility of manufacturers and suppliers;
  4. In the case of discontinued products, the exchange can be made for an equivalent or superior product to the one currently in commercialization, however, this exchange is exclusively the responsibility of the supplier/manufacturer. A credit note can also be made so that the customer can later purchase another item(s) in our store(s);
  5. RMA requests are made through our form. Failure to follow the procedures described in this form will lead to the return of the product at the Customer’s expense;
  6. Please note that any alteration to the original product will INVALIDATE THE WARRANTY. For example: removal of serial number stickers or other warranty labels, tampering, and incorrect installation. In all these cases the RMA is immediately REFUSED;
  7. Regardless of whether the equipment is under warranty or not, whenever it is received for repair and no malfunction is detected, or it was caused by misuse, a fee may be charged to cover logistical costs;
  8. The deadline for lifting the equipment for repair is 30 days after the document registration, otherwise, the material is considered abandoned in terms of art. 1267/1a of the Civil Code, so that Piranha Global Ltd. is no longer responsible for the integrity of the equipment. From the moment it is considered abandoned, the holder is obliged to pay as a penalty clause the amount of 2.5 Euro for each day of delay in lifting. After 3 years from the date of the respective document, and under article 1299 of the Civil Code, the equipment will become the property of Piranha Global Lda. by way of usucapiao. In case of debt, Piranha Global Ltd. has the right to retain all material on its premises until it is fully paid.

Collect & Return Guarantee

  1. This warranty is valid only for Piranha and META branded items purchased from our website or physical store;
  2. This type of warranty is valid for 1 year from the date of purchase;
  3. It includes the service of collecting the equipment when broken and returning it to the Customer’s home after repair within a maximum of 5 working days;
  4. To activate/use this type of warranty, simply contact Piranha Global Lda. through the e-mail info@piranha.com.pt and provide the purchase document number;
  5. In the event that the product is out of warranty (either because the warranty period has expired, or because there is possible evidence of misuse by the customer), the customer agrees to pay shipping and repair costs of $15. In the case of the Cheyenne Hawk the minimum value will be $45.

Warranty – Service/Repair

The repair warranty is 90 days from the date of completion of service, and the warranty is valid only for replaced parts (this limited warranty does not affect legal rights under national law). The warranty for repairs does not cover the following conditions:
Physical damage (broken/damaged/corroded/broken equipment, etc.);

  1. Misuse, damage caused by dropping, neglect, fire, water, electrical, atmospheric disturbances, etc;
  2. Damage caused by transportation carried out by the Client or third parties acting on his behalf;
  3. Use of options or consumables that are not appropriate for the equipment in question;
  4. During this period the equipment has undergone technical intervention, with labor and parts alien to the services of Piranha Global, Ltd;
  5. The previous repair has been carried out at the customer’s request and responsibility.
    Direct manufacturer warranty
    Some brands provide warranty / direct support to the Customer, in these cases you can contact the brand directly to deal with the warranty of the equipment.
